Suite a\u0300 la re\u0301cente de\u0301cision de justice condamnant les compagnies espagnole et irlandaise Vueling et Ryanair pour travail dissimule\u0301 par dissimulation d’activite\u0301 sur le sol franc\u0327ais, la Commission Europe\u0301enne, sollicite\u0301e par ces 2 compagnies \u00ab low cost \u00bb, demande des comptes a\u0300 l’Etat franc\u0327ais. La Commission Europe\u0301enne a en effet donne\u0301 10semaines a\u0300 la France pour justifier son refus d’accorder le statut de travailleurs de\u0301tache\u0301s (formulaires E 101 et E 102) aux salarie\u0301s de Vueling et Ryanair exerc\u0327ant leur activite\u0301 en France.<\/p>\n

Ces compagnies, dont les mode\u0300les e\u0301conomiques et sociaux sont de\u0301sormais largement connus, non contentes d’avoir de\u0301tourne\u0301 pendant plusieurs anne\u0301es le statut de travailleur de\u0301tache\u0301 pre\u0301vu par Bruxelles, demandent cra\u0302nement a\u0300 la Commission Europe\u0301enne de forcer l’Etat franc\u0327ais a\u0300 accepter ces pratiques scandaleuses et ille\u0301gales.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

Or Vueling et Ryanair salariaient des Personnels Navigants sous contrats espagnols et irlandais qui ne re\u0301sidaient ni en Espagne ni en Irlande, et ne s’y rendaient pas non plus dans le cadre de leurs activite\u0301s professionnelles. Le but, a\u0300 peine de\u0301guise\u0301, e\u0301tait de venir profiter de l’activite\u0301 situe\u0301e en France sans contribuer aux syste\u0300mes de retraites (ge\u0301ne\u0301ral et comple\u0301mentaire obligatoire dans l’aviation civile), ni de s’acquitter des cotisations sociales inhe\u0301rentes a\u0300 tout emploi salarie\u0301 en France.<\/p>\n

Quand l’activite\u0301 est lie\u0301e a\u0300 une zone ge\u0301ographique et donc pas de\u0301localisable, la solution est toute trouve\u0301e : on de\u0301localise l’humain et avec lui tout un syste\u0300me social !<\/p>\n

Loin d’e\u0302tre surpris que des entreprises peu scrupuleuses y aient pense\u0301, nous ne pouvons imaginer que la Commission Europe\u0301enne le\u0301gitime ce fonctionnement et encore moins qu’elle le de\u0301fende.<\/p>\n

Nous rappelons donc aux de\u0301pute\u0301s du Parlement Europe\u0301en ainsi qu’a\u0300 la Commission Europe\u0301enne qu’il est de leur responsabilite\u0301 de s’assurer que le principe de Marche\u0301 Unique et de libre circulation des biens, des services, des capitaux et des personnes ne soit pas de\u0301tourne\u0301 a\u0300 des fins d’optimisation fiscale ou de dumping social par les entreprises au de\u0301triment des citoyens ou des e\u0301tats, membres de l’Union Europe\u0301enne. L’Union Europe\u0301enne ne peut se faire l’avocat de la \u00ab casse sociale \u00bb dans ses e\u0301tats membres au risque de se voir renie\u0301e par les citoyens et e\u0301lecteurs en son sein.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

  • de le\u0301gife\u0301rer et d’encadrer le statut de travailleur de\u0301tache\u0301 pour lutter contre le dumping social et la concurrence de\u0301loyale associe\u0301s aux pratiques de certaines entreprises.<\/li>\n<\/ul>\n
